Buyer Protecction

Rules, Terms and Conditions of the "Buyer Protection Money-Back Guarantee" or "Basic Buyer Protection" (the "Official Rules")

These General Terms and Conditions apply to LW's "Money Back Guarantee" or "Basic Buyer Protection" (the "Buyer Protection").

1. Promoter: the contracting party determined in accordance with section "1.1 Contracting Party" of the Transaction Services Agreement (or the "Promoter").

2. Eligible Member: must be a registered LW member with a valid account and have made and successfully completed a purchase of goods and/or services on Life Waterproof.

3. Buyer Protection Period: the number of days (shown/confirmed on the product listing page at the time the Eligible Member completed the purchase at Life Waterproof that guarantees the Eligible Member would receive the goods and/or services ordered, beginning on the day the Eligible Member completes such purchase at Life Waterproof.

4. Rules:
a. If the Eligible Member does not receive the goods and/or services within the Buyer Protection Period, the Eligible Member may initiate the dispute procedures set forth in Life Waterproof under "Disputes and Reports" to report this incident ("Dispute Procedures") to Life Waterproof.

b. During the Dispute Procedures, Life Waterproof will investigate this incident by considering (but not limited to) the following factors:

i. Whether the goods and/or services received by the Eligible Member are damaged or defective;
ii. Whether the non-arrival of the goods and/or services to the Member is due to factors beyond its control;
iii. If the non-arrival of the goods and/or services to the Eligible Member is due to an error or miscommunication on the part of the Eligible Member (e.g., providing an incorrect shipping address, etc.); or
iv. If the goods and/or services are returned to the seller because such goods and/or services are unable to clear customs.

c. Life Waterproof may request information, documentation, records and/or other relevant evidence from the Eligible Member to support the Eligible Member's claim.

d. Following the Dispute Procedures, Life Waterproof will make a determination (which will be final and non-appealable). If the decision is favorable to the Eligible Member, subject to the terms of the Official Rules (including but not limited to the force majeure clause below), the Eligible Member shall be entitled to a refund within 15 days of the completion of the Dispute Procedures. Such refund shall generally be paid in the same means of payment used by the Eligible Member when placing the affected order with Life Waterproof, unless the parties have agreed on some other means and subject to the relevant technical limitations.

5. 5. General Rules:
a. By participating in this Buyer Protection, you agree to be bound by these Official Rules.

b. Any fraud and/or abuse by you (as determined by the Promoter in its sole discretion) will result in forfeiture of your right to participate in this Buyer Protection and/or your rights under these Official Rules.

c. Life Waterproof is not responsible for any entry, response or other correspondence, whether by email or otherwise, that is late, lost, late, incomplete, illegible, misdirected or undeliverable.

d. Eligibility for this Buyer Protection will be determined by Life Waterproof in its sole discretion based on the Developer's record. If there is any discrepancy between the transaction record held by you and that held by the Promoter, the Promoter's record will be conclusive and binding on you.

e. Life Waterproof reserves the right to modify these Official Rules without notice. In the event of litigation, the decision of the Promoter shall be final and binding.

f. Life Waterproof reserves the right and absolute discretion to cancel or revoke the right of any person to participate in this Buyer Protection.

6. 6. Force Majeure: Under no circumstances shall Life Waterproof be held liable to the Eligible Member for this Buyer Protection or any rights arising under these Official Rules due to or resulting directly or indirectly from acts of nature, forces or causes beyond Life Waterproof's reasonable control, including without limitation, Internet failures, computer, telecommunications or any other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, or default of third parties or any suspension or interruption of transportation or business operations (including, without limitation, delays or interruptions of resumption of work or operations ordered by any governmental agency) in the event of national or regional propagation.
